
Citizens Action Coalition of Indiana, Inc., et al. v. Duke Energy Indiana, Inc.,, et al., Indiana Court of Appeals Cause No. 93A02-1301-EX-76 (pending). This case is an appeal of an Indiana Utility Regulatory Commission (IURC) decision granting Duke Energy Indiana, Inc. (Duke) approval to recover from Indiana ratepayers $2.595 billion (plus certain financing costs) related to the construction of a coal gasification plant in Edwardsport, Indiana. The plant was initially approved at a projected cost of $1.985 billion, but cost overruns and long schedule delays have increased the estimated total cost of the plant to over $3 billion.
